Apa Pilihan Selepas Ini Untuk Rakyat Sarawak?

What Next For Sarawakians?

Please vote on the right. Only Sarawakians please.

Explanatory Notes/Queries: Does Sarawak need a new party, given the fact that if PKR forms the next State Government, this will open the door to other Malayan parties like UMNO to come in? Can the present State PKR leadership garner the support of the Dayaks, the Orang Ulu and the Malay/Melanaus, given that most of the Chinese majority seats will be contested by DAP? Is it capable of doing so?

If PKR or Pakatan Rakyat comes to power in Sarawak, this will mean that for the first time, Sarawak politics will be directly determined by Malayan-based political parties (PKR and DAP, maybe even PAS) instead of Sarawak-based political parties themselves.

Is this a better alternative to the present situation where even UMNO cannot come into Sarawak directly? Sarawakians have to ask themselves whether Sabahans are better off under direct UMNO rule? The answer is probably "no".

Sarawakians will therefore also have to ask themselves whether Sarawak will be better off under direct PKR rule or under a new Sarawak-based party which will take the place of PBB, SNAP, MDC, PRS and SPDP as part of Pakatan Rakyat? Is there anyone in Sarawak who can unite these diverse elements?

Sarawak Headhunter has a preference for the latter because this will mean that to a great extent Sarawak's autonomy will be better preserved than having to kow-tow to the Malayans, even under Anwar. At the same time, Sarawak will still have a say in the Federal Government through Pakatan Rakyat when it comes to power.

Otherwise, independence is or should be the ultimate solution.

Based on feedback, Sarawak Headhunter will soon be coming out with an open letter to all Sarawakians to determine the direction Sarawakians should or want to take to achieve the goal of political, business, economic, administrative and land reform (amongst others) for Sarawak.

Once this is determined, then Sarawakians can discuss constructively and decide the strategies and practical policies and moves to be implemented to achieve a change of government for the betterment of all Sarawakians, irrespective of race, creed or religion.

State PKR Chairperson YB Dominique Ng has confirmed that the 3 are Paul Raja, a Kelabit from Bario, Harrison Ngau, a Kayan from Baram and Baru Bian, a Lun Bawang from Lawas. This will strengthened the composition of its multi-racial membership base and the trio are expected to be fielded in the three Orang Ulu majority State seats of Telang Usan, Ba’kelalan and Belaga respectively.

Datuk Seri Anwar Ibrahim the de facto leader of Parti Keadilan Rakyat (PKR) arrived at 3.30pm this afternoon and headed directly to to close a one-day seminar which was an “Induction for the New Leaders” amongst them were 7 Lawyers, 3 Professors, 2 Phd Holders and 3 Accountants. Tonight he will be the guest of honour at a dinner at Lok Thian Restaurant Kuching which will be attended by PKR members, supporters and friends.

Tomorrow the 24th of May 2008 Anwar will head to Lubok Antu which is in Sri Aman to launch the party’s new Lubok Antu division. According to our sources a huge crowd of 2000 is expected where Nicholas Bawin Anggat (former MDC protem President) will be named to head the New Division. Last month he was in Kuching where he launched the Mambong division(picture).

With this addition of No.15 Lubok Antu Division PKR has expressed confidence given the mood swing in Sarawak that they will provide an alternative to the ruling BN coalition in the rural areas. The voters in Sarawak will have their voices heard in the Ballot boxes in the Sarawak State elections due in 2011. The sideshow has just begun…..Hmmm..Do you agree?

Who Do You Think These Sarawak MPs Represent? Taib Mahmud of Course!

The Shameful and Irresponsible Sarawak Members of Parliament

April 21, 2008 · Opinions & Commentaries

As highlighted by a blogger couple of days ago, 29 members of parliament including seven from Sarawak failed to submit their questions to parliament recently. What amazed me, is that some of them were former ministers, deputy ministers and seasoned MPs.

If the new MPs can get away with answers such as “I didn’t know the procedures” etc, those who have been in parliament for 20 years definitely can’t. For whatever the reasons they gave - they’ve betrayed the rakyat's trust on them and also that of the Prime Minister who has chosen them to represent Barisan Nasional.

Datuk Haji Wahab bin Haji Dolah - Igan
Datuk Wahab won the Igan parliamentary seat without contest during last March 8 election. Since he won the seat without contest he probably thought he can skip the 'question and answers' session in parliment.

Billy Abit Joo - Hulu Rejang
Billy Abit Joo - has been Hulu Rejang MP for 20 years now. If he can get away during the 20 years of his tenure as MP for Hulu Rejang, there is no reason why he can’t this time.

The fact that the Kayan, Kenyah, Punan, Penan, Iban and other in Hulu Rejang constituency continue to elect him shows that he had served them. But kinda pity those who have put their trust in him and being repaid in this manner.

Hulu Rajang is one of the least developed areas in Sarawak. To get to Long Jawe for example takes two days long boat ride. There is no way to know whatever happen in the outside world in this remote place.

Ding Kuong Hiing - Sarikei
Typical of any BN reps. During his campaign Ding promises all sort of things - including setting up of Tunku Abdul Rahman College in Sarikei. However, when it comes to performing his duty as MP - “aiyoo…forgot la”. Well Ding, you can get away this time, we know you’re busy lobbying for TARC.

Dato’ Dr James Dawos - Mambong
Just like Tiki, James Dawos didn’t think the Bidayuh has any question to ask. They don’t have representation in cabinet - who cares? Bidayuh didn’t care, only Tiki does.

Datuk Dr Tiki Lafe - Mas Gading
The only matter to this guy is that he is in the cabinet. He went on revolt recently over his dismissal - trumpeting the Bidayuh have been betrayed and sidelined. Perhaps, still being bitter about the whole thing he decided the Bidayuh shouldn’t ask any questions anymore.

Dato’ Sri Muhammad Leo Michael Toyad Abdullah - Mukah
Rumored to be the next TYT of Sarawak, therefore he can get away with it. Anyway, there is nothing Mukah ever needed it doesn’t have now. A university, a SCORE, including the Chief Minister of Sarawak!

William @ Nyallau Anak Badak - Lubuk Antu
This guy seems to have forgotten the “Antu” at Lubuk Antu once he was elected. Kick him out come next election would you antu?

Natives of Sarawak In Any Of These Dam Areas, Beware!

Sarawak to have 52 dams in year 2020

May 21, 2008 · Btu.Org

Sarawak Energy Bhd (SEB) has identified fifty two (52) dam sites for hydro power projects (including Bakun) for the whole of Sarawak when Malaysia aspires to be fully developed nation in year 2020.

Once completed, these hydro powers will generate a whooping 25,000 MW reported Eastern Times in a special tribute to Sarawak Chief Minister's 72nd birthday today. Murum dam expected to commence by the second quarter of the year will generate at least 944 MW.

Other dam sites identified by SEB include Baram (1,000 MW), Metjawan (300 MW), Baleh (1,400) and Limbang (150 MW).

The report said with Sarawak currently undergoing a second wave of development, demand for electricity will increase in order to attract energy intensive industries.

Government have identified 67 industries for the SCORE corridor, however priority will be given to only 10 industries. These include oil-based, aluminium, metal based including steel, nickel, zinc, gas, tourism, palm oil and timber based industries.

Once these industries start operating - Bintulu will be the world's most polluted place on earth - I predict. How will Similajau National Park in particular and tourism in general fit into this and thrive?

Is Bakun In The State or National Interest? Or Whose Interest?

KUCHING: The High Court in Kuching ruled that Sections 5(3) and (4) of the Sarawak Land Code which authorised the Minister for Planning and Resource Management to declare, by Gazette Notification, the extinguishment of native customary rights (NCR) over State land, and that compensation is to be paid to the rightful claimants of such NCR, are valid and constitutional.

In his Judgment, made available yesterday, Justice Dato' Abdul Aziz bin Abdul Rahim held that the ministerial direction gazetted as the Land (Extinguishment of Native Customary Rights) (Kawasan Kebanjiran Bakun II) (No. 26) Direction 1997, which came into force on 23.6.1997, is valid and effective.
The High Court in Kuching ruled that the extinguishment of NCR land surrounding Bakun dam is constitutional

The High Court in Kuching ruled that the extinguishment of NCR land surrounding Bakun dam is constitutional

The extinguishment of the NCR belonging to a group of Orang Ulus led by their headman, Bato Bagi, residing on land along Batang Balui and its tributaries in the Belaga Division was validly effected according to the law.

In the action filed in the Kuching High Court, the natives have challenged the extinguishment of their NCR over land which would soon be flooded to create a reservoir for the Bakun Hydro-electric Project.

The Government had agreed to compensate them, but the natives had decided to challenge the extinguishment of their NCR on constitutional grounds in, that they had cultural attachment to what they considered to be their "ancestral" land and their livelihood depends on their continued occupation of their native customary land.

The Government took the stand that their land is required for a public purpose, namely, the implementation of a national project as hydro power generated at Bakun would be transmitted to Semenanjung Malaysia.

Justice Dato' Abdul Aziz held that though the common law respects the pre-existence of rights under native laws and customs over land, such rights may be taken away by clear and unambiguous words in a legislation.

He held that in the context of Sarawak, Section 5(3) of the Land Code is clear· enough to permit the extinguishment of NCR with provision for compensation.

He held that Section 5(3) did not infringe Article 13(1) of the Federal Constitution which provides that no person shall be deprived of property save in accordance with the law and that law must' provide for adequate compensation.

He held that both these requirements were satisfied by the provisions of Section 5(3) and (4). On the issue raised by the Plaintiff that the process of extinguishment of NCR by the Minister lacked "procedural fairness", in that the natives were not consulted prior to the extinguishment of their NCR, Justice Dato' Abdul Aziz held that the decision to extinguish the NCR by the Minister is "an exercise of administrative discretion depending on the exigency and expediency of the State."

He held that:"In my view land development and planning for land use in the State is the prerogative of the State. The State needs to act with speed and expediency when planning for the development of the State for the good of the public.

This speed and expediency would be lost if the State is required to accord a right to be heard to every native who claims to have rights to use State land over which NCR is said to subsist before gazetting a Direction under the impugned provisions to extinguish such rights over land required for development.

This will impede the State in carrying out its planning for land development and land use in State particularly, and the development of the State generally since land is one of the most important factors in development planning."

Based on these grounds, the Court held that under Section 5(3) and (4) of the Land Code, the State Government is not obliged to accord the natives the right to be heard before issuing the direction on the extinguishment of the NCR, and that the law under which the Government extinguished the NCR is valid and constitutional.

The natives were represented by Raja Aziz Addruse, a senior member of the Malayan Bar and Mr. Paul Raja of Sarawak. Datuk J.C. Fong, State Counsel (former State Attorney General) together with Mr. Joseph Chioh, appeared for the state government.

Additional Information. The area where the NCR was extinguished is to be flooded to form the reservoir for the Bakun Hydro-electric Project. Civil works on the 216m tall Dam have been completed and the impounding of the river to create the reservoir is likely to start very soon.

The outcome of the decision means that the NCR issues surrounding the Bakun Hydro-electric Project have been substantively resolved.

The Plaintiffs in the case are Bato Bagi, Bit Buneng, Siring Angah, Dato Lian, Awan Aing and Ngajang Midin. The sole Defendant is the Government of Sarawak.

Question In Parliament

One question Sarawak Headhunter would really like to hear being asked in Parliament is:

How much did UMNO actually pay for the PWTC (including the Menara Dato Onn) and how much did Bank Bumiputra and also Maybank have to write off on UMNO's non-performing loans (which stood at RM850 million in 1985)?

OK, that's two questions in one, but Sarawak Headhunter suspects that the answer will surprise everyone, including all those clueless ordinary UMNO members who have been taken for a very long, expensive and harrowing ride by their leaders - all in the name of "Ketuanan Melayu" or is it "Kenakan Melayu"?

NCR - Masing owes Dayaks one big explanation

I was baffled and astonished to read the remark recently by James Masing (PRS half-president) in referring to a DAP state assembly person’s debate on the land issue in the Sarawak state assembly as a ‘cultural arrogance". I wonder, with his doctorate in anthropology, yet he has invented such term which to him simply means: ‘Don't tell the Dayaks what land means to them and what Dayaks need to do to develop such land’.

In other words, Masing was telling the world that the Dayaks (Masing included) already knew all issues related to land development (including all the amendments to Land Code and other laws related to land) and need no help from non-Dayaks.

Well, well, here we go. I am even more shameful when it takes Chinese state assembly persons (Ting Tze Hui (DAP-Meradong) and Voon Lee Shan (DAP-Batu Lintang) to raise the issue concerning Dayaks most revered heritage (land) whilst the bunch of 26 Dayak so-called YBs sit in deafening silence in the dewan echoing what Masing said. Forget about scoring political mileage.

My questions are: Do you all (Masing and the 26 Dayak YBs) really fully understand the subsequent implications of what the Land Code’s recent series of amendments were? Do you all truthfully believe it when the Minister of Resource Planning (Taib Mahmud) explained in 2001 that the amendment (and subsequent ammendments) were necessary to enable and allow for smooth land transactions involving native customary rights (NCR)?

Have you all forgotten that in1965, the so-called ‘The Land Bill Crisis’ when the then CM Kalong Ningkan tabled the Land Bill, almost similar to the current amendment, but the Bill was withdrawn as it received objections from a majority of the state assembly persons then? This then led to the unpopularity of the late Kalong Ningkan.

Since you, Masing, claim to be the supremely knowledgeable person to speak about land and NCR issues, I beg you to justify the state government’s wrongdoings and systematic extinguishment of our NCR by giving satisfactory explanations to these questions.

Did you all honestly know that the whole Land Code Amendment intention was to facilitate the acquisition of native land to be developed into large-scale oil palm plantations? Do you all not know that as the Land Code amendments stands now, Native Customary Rights over land may be extinguished via the Land Code?

Do you not know that surveys to determine the compensation payable are being questioned and challenged as being arbitrary? Do you all not already know that some communities who are challenging the extinguishment of their land rights and compensation are those who have been affected by the Bakun Dam project and the Borneo Pulp and Paper Project in Bintulu?

Do you not know that for the Dayaks, land is not a commodity to be simply traded for money? That Land is a living entity that is precious and holds a deep spiritual meaning for us and is revered in our society and this also means that it cannot be simply be bought and sold?

You and your shameful Dayak state assembly colleagues owe the whole Dayak community and our generations an explanation to justify the Sarawak government’s ruthless and inhumane treatment of defenders of NCR.

If you can't justify these actions, then let others do. But what does this mean? It means you and your bunch of ‘mentally arrogant’ Dayak YBs are irrelevant and be ready to be voted out - sooner than you think.

The Reality in Sarawak After 45 Years

The Reality in Sarawak After 45 Years

Posted by The People's Government on May 14, 2008 at The People's Power.

The People’s Power appreciates the comments from concerned people on the political scenario in Sabah and Sarawak. Thank you for the comments. But fighting for the struggling people of both states is just the beginning.

While BN always got their boosting win from the bumiputera candidates, the eyes are always focused on hot seats in constituencies where Chinese votes hold the majority. Too bad, the tsunami wave didn’t really materialize in Sarawak this time.

But for those of you who are die hard fans of BN, do you really understand the reality after 45 years of BN’s reign in Sarawak?

Sarawak has a lot of rich and famous Made in Sarawak politicians and tycoons but still having many people living in poverty. The fact is Sang Rambut Putih, Dr. G and their political cronies are getting richer each day. The same goes to the fortune reapers who devote themselves kissing these politicians’ feet. Many have been living in big mansions, buying properties everywhere, expanding business empire elsewhere and some with new mistresses too. It’s a type of political pyramid scheme exercised by them. Normal and disabled people face a huge economic gap compare to those fortunate people. Many are still fighting for the basic needs. Forget about been the biggest group at the low level of the pyramid working hard contributing to the economy of the state but in return receiving insufficient wages. Some don’t even have proper access to clean water, electricity, health and education.

The state also has the richest, the biggest forests, oil & gas in Malaysia but receiving minimum royalty back to the state. It’s a form of exploitation and humiliation by the Federal government to the people of Sarawak. The people don’t want to elaborate more on this, this reality is known to everyone in the country.

The secular education fails to achieve its purpose to educate people to the highest. Many in rural area leave schools as early as primary level due to unawareness of education values and poverty issues in family. Still there are others who still can’t read and write. A similar problem compared to the Orang Asli in Peninsular.

The government has failed to fulfill their obligation to ensure a safer environment for people. The state has experienced some of the gruesome criminal cases involving innocent people over the past few years. While many arrests had been made on Along due to their harassment to the people, other crimes such as armed robbery, which include robbery cum murder cases, have increase drastically over the years; needless to say, the petty crimes such as snatch thieves, stealing of steels from public and homes are also on the rise. Good thing is Dr. G seriously highlighted the measures to counteract criminals in the DUN assembly after his own home was broken-into not long ago.

Majority of properties in Sarawak are normally 60 years leasehold. With land values on the rise and property prices booming, there will be scenario in future where many people can’t afford to renew the tenure and on the line to lose their only place called home. Which means that no houses are free, even though the loan payment has been completed.

So after knowing some of the reality, would you like the same Blood Suckers to serve you again?

Sarawak's Useless MPs

By Iban Baru

Sekian

Masing's Cultural Arrogance

Masing defends ‘cultural arrogance’ theory

(Sarawak Headhunter’s interpolations in red, partly what Masing really meant and partly what Sarawak Headhunter thinks he meant. If you are not thoroughly confused at the end of it, please feel free to read more of Sarawak Headhunter's serious but amusing musings from time to time).

(Borneo Post) KUCHING: Land Development Minister Dato Sri Dr James Masing yesterday defended his “cultural arrogance” theory, saying that it is a theory urging people not to preach to people from another community on what they already know like telling the Ibans that they are disunited or that their leaders are motivated only by self-interest.

Cultural arrogance breeds racial disharmony and is a form of insincerity, he said just like the arrogance of Iban leaders breeds disharmony among the Ibans and is also a form of insincerity.

It is therefore wise for people to think that all are born equal in intelligence although of course you all are not equal to me since I have a Phd, but you can think so. But what makes us different from one another is opportunity and I am an opportunist par excellence. Some get more opportunities than the others because they grab all they can get from Taib Mahmud, just like me. If I get peanuts how can I give bananas to my people? Even if I get more than peanuts, why should I give anything to my people, who are happy with nothing? Therein is the difference, you all can’t do what I do,” he said in his winding-up speech at the DUN yesterday.

Masing said it would be cultural arrogance, if a Chinese tried to help the Ibans but yet preached to them (Ibans) things they already knew but since the Ibans don’t help each other but are forever fighting with each other, it is also arrogance if an Iban tried to help other Ibans but yet preached to them things they already knew, even if what they already knew can’t hurt them as much as not knowing what they should know.

He pointed out that such incident happened during the land-related disputes or claims which are all started by you know who and his unjust and lop-sided land policies but we Iban leaders cannot say that so we grab what we can, which is whatever he gives us, while we can. Otherwise he will give it all to the Chinese Towkays, which he has already done anyway and which we already know.

If you want to help others, just do it. There is no necessity to tell the world why a person needs such assistance. By the same token, if you want to help an Iban with his land, there is no need to tell him or this Dewan what land means to an Iban,” he cited an example of ‘cultural arrogance’. “Land doesn’t mean anything to the Ibans because the land doesn’t belong to them, and Taib Mahmud can do what he likes with the land. I cannot do anything to help the Ibans. How can I be arrogant even if I have a Phd? Of course I am but it would be cultural arrogance on your part to tell me what I already know."

Masing said he once helped a Chinese shopkeeper to get a streetlight from a local council here after the shopkeeper requested for it, and sought for his assistance. ”I cannot do anything more than this. That is how much power I have in Taib’s government, but the pay and the pay-back is good for me, even if not for my people. That is the truth, and it is arrogance to tell you what you already know.”

Although he knew that the shopkeeper needed the streetlight to protect his shop, he (Masing) did not preach to him on why he should need the streetlight or the rationale of having one, Masing said since he (the shopkeeper) already knew why and he might find a rationale for hitting Masing on the head with the streetlight.

He pointed out that such a gesture was not cultural arrogance because he helped the Chinese with sincerity. However, by telling everyone about it now, that is cultural arrogance, but we cannot tell him that because he already knows it and that is also cultural arrogance.

It was also a sincere act because he did not tell the media about it nor did he argue the shopkeeper’s case in the DUN, he added. Now it is not so sincere anymore because he is telling everyone. But no one should tell him that since he already knows it and that would be cultural arrogance.

He said this to rebut some points raised up by Ting Tze Hui (DAP-Meradong) and Voon Lee Shan (DAP-Batu Lintang) when debating the Head of State’s address last week. He had nothing else to rebut of course, but we cannot tell him that, since that would be cultural arrogance, as he already knows it.

Masing first mentioned the cultural arrogance theory during his winding-up speech in a DUN sitting in 2007. It was part of his Phd thesis and the only thing he knew a lot about, being himself arrogant, culturally or otherwise.

However his points on cultural arrogance yesterday did not go down well with Dominique Ng (PKR-Padungan), who interrupted him several times telling the DUN Speaker that such talks had racial overtone. Of course this is cultural arrogance on the part of Dominique Ng since both the DUN Speaker and Masing knew this already.

Ng was also unhappy when Masing stressed on the history of ancient China where its people then addressed non-Chinese as “barbarians”. This is ancient history but Masing wanted to show how smart he was in remembering this, without realizing that everyone already knew it, especially Dominique Ng who therefore had every right to be upset since he did not like culturally arrogant people preaching to him. In particular he did not like being reminded that his race once called everyone barbarian. How to be culturally sensitive like that? Arrogant Iban!

Why? Because the perception of the ancient Chinese that all non-Chinese were savages; they lacked culture and did not possess any skills and therefore are not capable of doing anything good and worthwhile,” he explained. This was such a good explanation, thereby showing everyone why he got his Phd.

He said another form of cultural arrogance manifested itself in some people’s attitude and perception towards others but not his of course.

There is a general perception by others in Malaysia that Bumiputeras are not capable of doing good and successful business. Hence when a Bumiputera company is successful, the perception is that it cannot be attributed to their skills and capability. Thus, variables like cronyism, nepotism, corruption and political patronage come to the picture. This is not what I say but what other people say, even if we all already know it, have to pretend lah that we don’t know otherwise kena belasah lah by you know who!

These are variables the detractors claimed, which account for this Bumiputera company to be successful,” he said. “It is not only cultural but also political arrogance to say this since we all know it already”.

Yet another form of cultural arrogance is in the manner some people address or refer to others. “I’m not trying to be arrogant here, if I want to be arrogant I don’t even have to try, even if you all already know this. I’m just trying to justify my Phd, which means I’m smarter than all of you, as you all already know. But I’m not smarter than you know who, otherwise I would be Chief Minister long time ago.

During my growing up years, the Ibans in Kapit were referred to or called by the Chinese as ‘Lakkia’ (native or wild savage). I did not take any offence then. Now I do. I will not take this form of address too kindly,” Masing said, "especially if my wife calls me this, but then again why should I bother since I am her laki ah! Only sometimes of course. Sometimes I am other people's laki lah!

When Ng still insisted that Masing’s speech had some kind of “racial slur”, DUN Speaker Dato Sri Mohamad Asfia Awang Nasar told Masing to proceed to another point but reminded all members to stay clear of racial remarks. Haha, right! Correct! Correct! Correct! And don’t forget, the Sarawak Headhunter told you so, even if you already knew it, and he wasn’t trying to be arrogant, culturally or otherwise. So ended Masing's preaching to the DUN on cultural arrogance. Other than for Dominique Ng, the rest of the DUN were totally unaware of what he meant he said or what he said he meant, which was both confusing (him) and confused (them). However, don't be culturally arrogant and tell him this, since he already knows it (that he is confusing and everybody else is confused) - that is how he got his Phd. after all.

Sarawak Headhunter is contemplating putting up Masing's head on the list of heads that must roll. This guy must surely rank as one of the stupidest Phd's ever produced by Sarawak.
